After opening the continued hearing, Cliff Matthews stated that the applicant has submitted a letter to the Commission withdrawing their Notice of Intent. The Commission closed the hearing.

Bob Poxon (G&H), Don Seaburg and property owner Brian Sherry were present when Cliff Matthews opened the continued hearing. Mr. Poxon stated that the applicant has submitted a newly revised plan changing the location of the drain onto Lot 8 again and creating some grading changes to direct runoff into the proposed drain. Mr. Poxon also included erosion control on the plan. He explained the grading change design to Mr. Sherry. Mr. Poxon also stated that the newly revised Operation and Maintenance Plan requires that current property owner, Mr. Sherry, would be responsible for the maintenance of the drain. Mr. Seaburg stated that the site would be stabilized with seed once the work was complete. It was anticipated that the work be completed as soon as possible with additional seeding to take place in the spring if further
stabilization is necessary. Mr. Sherry was anxious to have the project completed. Barry Lariviere (newly married) made a motion to close the hearing and issue and Order of Conditions. Neal Standley seconded and the Commission voted unanimously to do so.

Attending the hearing were Bob Frazier, Ann McMenemy, David Albrecht, Austin Turner, Tom Sexton and abutter, Mr. Bob Daley. After Cliff Matthews opened the continued hearing, Mr. Turner stated that TetraTech has had several meetings with peer reviewer, Tom Sexton, in an effort to resolve some of the outstanding technical issues in the peer review comment letter. Tom Sexton stated that the groundwater separation issue in the basins is still an outstanding issue but that many other items have been resolved. Mr. Matthews suggested that Mr. Turner discuss those items that have been discussed with Tom Sexton thus far utilizing Tetra Tech’s suggested categorization. The following items are contained in Category 3:
*Comment 37 pg 10, addressed. Tom Sexton said that there was a change in proposed basin width of 15 to 20’ and a change in crown berm of 1/10 of a foot. The plans must be revised (Sheets R6, R7, R8, etc.)
*Comment 46k pg 11, addressed provided the Special Conditions refer to a requirement that construction activities be subject to a NEPDES permit.
*Comment 48a pg 11, addressed provided the developer establish a stormwater annuity account which will be a Special Condition in the Order of Conditions.
Mr. Frazier stated that as of the present, the ownership of the roadway is undetermined but that if the state or town were to accept it, W.S. Development would continue to maintain the stormwater structures.
*Comment SWM4 pg 22, partially addressed. The applicant will provide more information relative to basin bottom slopes and diameter of orifice vs. width of slots for outlet structures.
*Comment 7C pg 23, addressed provided the applicant amends the Operation and Maintenance Plan to trigger forebay cleaning and to install a visual marker to indicate sediment depth.

Cliff Matthews stated that time had elapsed. After discussion, the applicant agreed to a one half hour continuation of Wed. Nov. 9th at 8:00 PM. The Commission voted unanimously to continue to Nov. 9th at 8:00 PM.

Vin Forte was present when Barry Lariviere opened the continued hearing. Mr. Forte presented the revised plans dated 10/6/2011 that were previously submitted to the Conservation office. The revised plans show the fence relocated to the 25 foot No Disturb Zone boundary. Mr. Forte stated that the note referring to connection to town sewer was removed from the plan. He also stated that the Board of Health approved the slight modification to the location of the proposed septic tank. Mr. Forte noted that the plantings would be both shrubs and wildflower mix in the No Disturb Zone areas once that area was cleaned of debris. Since the plans only note wildflower mix, the Commission agreed to add a Special Condition requiring the applicant to contact the Conservation Commission on the types of shrubs that he proposes to include in the
plantings before that work takes place. Mr. Forte suggested Vibirnam, Blueberry, etc. Motion was made to close the hearing and issue an Order of Conditions, seconded by Neal Standley and voted unanimously.

Don DiMartino, DPW Director was present when the meeting was opened. He stated that the proposal is to replace the existing degraded water pipe on Mann Street with a new water line, to abandon the old water line in place and to add a couple of new hydrants. When asked, he stated that there would be some excavation in unpaved surfaces to install the water line connections to existing homes. Cliff Matthews stated that when the Commission advised Mr. DiMartino that he should file an RDA, we were unaware that there would be any excavation outside the paved area of the road. The Commission was also unaware that there was the potential for dewatering operations in the event that the contractor hit groundwater during the installation of the water line. Cliff Matthews then recommended that the Commission include Special Conditions
in the permit as follows: George Holmes is to be notified before erosion control installation; where individual connections are installed within 100 feet of the resource area, hay bales must be installed around catch basins until the earth is stabilized; previous to any dewatering operations, the applicant must contact the Commission or its Administrator to institute dewatering proposals: filter bags must be utilized on all hose outlets. By unanimous vote, the meeting was closed and a Negative Determination with conditions was signed.

Paul DeSimone of Colonial Eng. was present when Cliff Matthews opened the hearing. Mr. DeSimone stated that the filing is for the proposal to construct a sewer connection to town sewer with a tie in at Pine Acres subdivision across the street on Wrentham Road. The applicant has purchased an easement from Mr. Dalpe and will be filing with the City of Woonsocket, RI for disposal permit. DeSimone stated that the original intention was to construct a new septic system on site but the soil conditions were unsuitable and the cost of installation was prohibitive. The filing before the Commission is the proposal to install two pump chambers (one located just within the 100 foot buffer zone) to utilize the two existing septic tanks and to install a 4,000 gallon grease trap and a 446 foot three inch force line (18 inches deep) to pump up
to the Pine Acres connection location. Cliff Matthews noted that there is a small amount of flood plain on the site but that it would not be impacted. There were no further comments or questions. Motion was made, seconded and voted unanimously to close the hearing and issue an Order of Conditions.

Cliff Matthews reported on the progress at the Pulaski Blvd. detention basins. Don DiMartino or Cliff Matthews will contact Phil Paradis of BETA to move the project along.
George Holmes reported that the Hartford Avenue culvert replacement is finally finished. Mr. Holmes has maintained a presence on the site and has contacted the contractor to request additional erosion controls to correct a small erosion problem on the site.
George Holmes will visit Dave Brown’s site to assess the progress with the violation notice.
Mr. Holmes also reported that 327 Farm St. Yacino property appears to be corrected from the recent violation notice.
A reminder was given to all Commission members that the Nov. 9th meeting will begin at 7:00 PM. Alice Smith of DEP will be presenting a one hour stormwater management presentation then.
Reminders were also made to all members to complete the Conflict of Interest tests and return to the Town Clerk.
Another reminder was that of the upcoming MACC Annual Meeting to be held in the beginning of March 2012.
After an update on the Crystal Spring Condo Conservation Restriction given by Cliff Matthews, the Commission voted to accept and sign the CR and to contact the Board of Selectmen to request their acceptance and signatures. Once signed, the CR will be sent back to attorney Steven Greenwald for processing with the Condo Assoc. and EOEA.
Site walks for Plymouth Road CR and 15 Mann St. were scheduled for Sat., Nov. 5th beginning at 8:30 AM.
By unanimous vote, the Commission went into executive session.
